In Brief

The Supreme Court reinstated employees of Uttar Pradesh Power Corporation Limited who were dismissed after being selected for Technical Grade-II (Electrical) posts. The applicants had been selected and appointed after possessing and producing required CCC (computer) certificates at their interviews in 2014–15. Later, the Corporation terminated them, claiming they lacked the certificate on the 2014 application deadline. The Court held that the advertisement and regulations required certificates at interview, not necessarily on the application date. Since the applicants had complied at interview and were not affected by a High Court judgment quashing only non-certified candidates, their termination was illegal. The Court reinstated them with seniority and all benefits (though not back wages), invoking its extraordinary power under Article 142 to prevent continuation of illegality.
