Sajid vs State of Uttarakhand and Another

Bench: 2 — Kurian

In Brief

A man convicted of kidnapping and abduction under Indian Penal Code Sections 363 and 366 appealed his seven-year sentence. The victim had since married another person and was living happily with no complaint against the appellant. The Supreme Court confirmed the conviction but modified the sentence to the period already served in jail. Instead of further imprisonment, the Court imposed a fine of Rs. 2,00,000 as compensation to be paid within one month. The Court held that where the victim has moved on and no further harm or community repercussion exists, complete justice required balancing punishment with changed circumstances.
