Saljan vs State of Kerala

Bench: 2 — 2

In Brief

The appellant was convicted under Section 324 IPC for voluntarily causing hurt, nearly 19 years after the incident occurred. The trial court sentenced him to three years imprisonment and fine; the High Court reduced it to three months imprisonment and fine. The Supreme Court held that, given the substantial delay in justice, the absence of any other criminal involvement, and the established guilt, it was unjust to impose jail custody. The Court modified the sentence to payment of Rs. 50,000 fine (with three months simple imprisonment as default), thus allowing the appeal in part.
