Pareshbhai Annabhai Sonvane vs State of Gujarat & Ors

Bench: 2 — Shiva Kirti Singh

In Brief

The appellant was convicted of dacoity (robbery) under Section 395 IPC with accomplices for stealing goods and cash worth Rs. 16,550. The trial court sentenced him to one year imprisonment, considering his young age (21-22 years) and low value of loot. The State appealed to enhance the sentence to five years, which the High Court allowed. The Supreme Court held that the original sentence was justified and reduced the appellant's sentence to the period already undergone in prison (three years and two months since July 2008). The appeal was allowed, and the appellant was ordered released unless required in another matter.
