In Brief
An employee of the West Bengal Government applied for voluntary retirement but was rejected because he had not met the age and service requirements at the time of application. Under Rule 75(aaa) of the West Bengal Service Rules, employees who entered service after age 35 must be 55 years old and have completed 20 years of service to retire. By the time of this appeal, the employee had satisfied both conditions. The Supreme Court allowed him to reapply, directing the authorities to process his fresh application within one month and consider it in accordance with law. The Court did not definitively settle the underlying question of law on the timing of eligibility criteria.
