In Brief
Samar Kumar Das applied for voluntary retirement under West Bengal Service Rules Rule 75(aaa) but was rejected because he had not attained age 55 years and had not completed 20 years of service. Rule 75(aaa) permits employees who entered service after age 35 to retire only after reaching age 55. The Supreme Court held that having now satisfied both conditions, the appellant is entitled to file a fresh application, which the Competent Authority must consider and decide within one month in accordance with law. Appeal allowed.
