The appellant, an elected President of a Municipal Council, was disqualified from office following unauthorized construction work. She argued that her husband carried out the illegal structures, not she, and that she should not be held responsible for his actions. The Supreme Court held that while a Councillor is primarily disqualified for personally constructing illegal structures or directly assisting in such construction as a Councillor, the statute also disqualifies when temporary illegal structures are made by a spouse or dependent. The appeal was dismissed and the disqualification order upheld.
