Sandeep @ Babu Bhausaheb Kate vs State of Maharashtra

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Sandeep @ Babu Bhausaheb Kate, Raosaheb Vithal Pisal and Sanjay Maruti Samge were convicted of kidnapping and murdering Ravindra. The Supreme Court found that while the eye-witness evidence identified Popat Khandu Pisal as the person who struck the fatal blow, there was no clear evidence that the appellants shared a common intention with him to cause death. The Court held that mere presence at the scene without proof of shared intention was insufficient for conviction and that the appellants were entitled to the benefit of doubt. Their conviction and sentence were accordingly set aside and they were acquitted.
