Sangeeta & Ors vs Krishan Kumar & Ors

Bench: 2 — Kurian

In Brief

In a motor accident compensation appeal, the Supreme Court addressed an error in the High Court's order that enhanced compensation to Rs. 12,12,000 but applied 9% interest only to the enhanced portion (Rs. 2,27,000). The Court held that this was unjust and incorrectly applied. The appellant is entitled to 9% interest per annum on the entire compensation amount from the date the claim petition was filed before the tribunal. The appeal was partly allowed, and amounts already deposited by the insurance company would be adjusted accordingly.
