Sangita @ Rekha Sambhaji Malode vs State of Maharashtra

Bench: 2 — Banumathi

In Brief

The appellant, sister-in-law of the deceased Surekha, was convicted under Sections 498-A and 306 IPC (read with Section 34) for dowry harassment and abetment to suicide, and sentenced to two and five years imprisonment respectively. She appealed against the quantum of sentence. The Supreme Court held that considering her family responsibilities, lengthy incarceration already served since 2002, and peculiar circumstances, the five-year sentence for Section 306 was reduced to two years. The appeal was allowed in part. The order was made non-precedential.
