Sangita Vilas Ingle vs State of Maharashtra & Ors

Bench: 2 — Kurian

In Brief

The appellant filed a Criminal Writ Petition seeking protection, prosecution of police officers for torture and unlawful detention, compensation for violation of fundamental rights, and other reliefs. The High Court dismissed the petition summarily on the ground that it involved disputed questions of fact. The Supreme Court held that summary dismissal based solely on factual disputes was unjustified. Where serious allegations of torture, unlawful detention, and constitutional violations are raised, the writ petition must be considered on merits. The Court allowed the appeal, set aside the dismissal, and remanded the matter to the High Court for substantive adjudication within one year."
