Sant Lal vs Rajesh & Ors. etc

Bench: 2 — Arun Mishra

In Brief

The Supreme Court examined whether a driver holding a light motor vehicle (LMV) licence could legally operate a tractor with an attached trolley carrying goods without a separate endorsement. The MACT and High Court had found this violated insurance policy conditions. The Court held that if such a tractor-trolley falls within the LMV transport category, the LMV licence suffices without additional endorsement. No policy breach occurred. Consequently, the insurer's right of recovery against the owner was set aside, and liability remained jointly and severally on the owner, driver, and insurer.
