Sant Lal vs Rajesh & Ors. etc

Bench: 2 — Arun Mishra

In Brief

The Supreme Court addressed whether a driver holding a light motor vehicle (LMV) license can legally operate a tractor with trolley carrying goods without a separate endorsement. The Court held that an LMV license permits driving of transport vehicles classified as LMV without requiring additional endorsement. Since the tractor-trolley was an LMV class vehicle, there was no breach of insurance policy conditions. The Court set aside the insurer's right to recover from the owner and held liability to be joint and several among owner, driver, and insurer.
