In Brief
A tenant had appealed to the Supreme Court concerning a dispute with the landlord over possession of premises. However, before the appeal was decided, the tenant unconditionally surrendered vacant possession of the premises back to the landlord. This intervening development rendered the subject matter of the appeal moot. The Court held that when the core relief sought in an appeal is overtaken by events and no longer survives, the appeal cannot be sustained. Accordingly, the Court dismissed the Civil Appeal as infructuous.
