Supreme Court of India 2017-05-26 dismissed

Satish and another etc vs State of Haryana

Bench: 2 — Navin Sinha

In Brief

Appellants Satish, Kishan, and Anita were convicted of conspiracy and murder under Sections 120-B, 302, and 34 IPC for killing Anita's husband in 2007. The Supreme Court upheld their conviction, holding that while extra-judicial confessions are weak evidence, they can be sustained when corroborated by reliable eyewitness testimony. The child witness's identification was credible despite being given at trial (demonstrating courage in naming his own mother), and circumstantial evidence including the victim's unnatural conduct and multiple injuries supported guilt. The Court rejected speculative defences unsupported by evidence and dismissed the appeals.
