Supreme Court of India 2017-05-26 dismissed

Satish and another etc vs State of Haryana

Bench: 2 — Navin Sinha

In Brief

Satish and Anita were convicted of conspiracy and murder under Sections 120-B, 302, and 34 IPC for fatally assaulting Anita's husband in March 2007. The Supreme Court affirmed their life sentence. Although the prosecution relied partly on an extra-judicial confession by Anita (which was weak evidence), the Court found sufficient corroboration in the credible testimony of the couple's 12-year-old son (PW-2), who directly witnessed the assault and identified both appellants in court. The Court accepted the child's evidence as reliable, noting both trial and appellate courts had found him convincing and that he had courage to testify against his own mother. The FIR's eight-hour delay was not fatal, being reasonably explained by the nighttime occurrence and the informant's circumstances. The appeals were dismissed.
