The landlord Satish Chander Aggarwal sought eviction of a tenant to expand his family business (M/s. Roop Krishna Traders) in 1975. The First Appellate Authority granted eviction after spot inspection. After the landlord died in 2005, the High Court set aside the order, holding that the surviving heirs must separately establish bona fide requirement. The Supreme Court allowed the appeal, holding that since the legal heirs continue the same family business and the original requirement was properly established and verified, they need not litigate afresh. The original landlord's bona fide requirement for the family business carries forward to the legal heirs.
