Satyam Technocast vs Commissioner of C. Ex., Rajkot

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Satyam Technocast sought review of a Supreme Court judgment that had upheld central excise duty demands on the assumption that tax effect was minimal. The petitioner demonstrated the actual tax effect exceeded Rs. 27 lacs, not minimal at all. The Court partly allowed the review petition by remanding solely for the limited purpose of excluding job work procured from independent outside parties from total clearances and recalculating tax liabilities. The Commissioner was given six months to complete the exercise after affording proper opportunity to the respondent assessee.
