Satyama Dubey & Ors vs Union of India & Ors

Bench: 3 — S. A. Bobde, A. S. Bopanna, V. Ramasubramanian

In Brief

The Supreme Court heard multiple petitions regarding the alleged gang-rape, brutal assault, and death of a 19-year-old girl from Hathras, Uttar Pradesh, and the improper nighttime cremation of her body. Petitioners sought Supreme Court monitoring, CBI investigation, trial transfer to Delhi, and enhanced witness protection. The Court found that the Allahabad High Court had already assumed suo moto jurisdiction, and the state government itself had requested CBI investigation (which had commenced). The Court declined to monitor the case itself, leaving all matters for High Court consideration. As a confidence-building measure, it directed that security for the victim's family and witnesses be provided by CRPF within one week. The question of trial transfer was reserved for future consideration.
