The appellant, convicted of offences under the IPC and Prevention of Corruption Act and sentenced to concurrent rigorous imprisonment with fines, challenged the High Court's order requiring him to deposit the fine amount as a condition for suspension of sentence during his appeal. The Supreme Court held that Section 357(2) CrPC—which defers realization of compensation from fine imposed—does not apply to the fine itself as part of the sentence, but only to compensation payments. Since the trial court imposed no direction to pay compensation from the fine, Section 357(2) was not attracted. The power to suspend fine rests with the Appellate Court under Section 389 CrPC, independent of Section 357(2). The appeal was dismissed.
