The Supreme Court held the suit was not maintainable because: (1) the original sale violated the Urban Land Ceiling and Regulation Act's strict requirements—specifically Section 5(3), which prohibits transfers of ceiling land before both required conditions are met; (2) the permission granted was only for the seller's retainable land, not the disputed parcel; and (3) the suit essentially sought to challenge land ceiling proceedings, falling outside the civil court's jurisdiction under the ULCRA's comprehensive statutory scheme. The Court affirmed the Trial Court's dismissal, overturning the High Court's reversal.
