A property owner claimed to own land previously held by Zahid Hussain under the Urban Land Ceiling and Regulation Act (ULCRA). Zahid Hussain had allegedly sold the land to the owner through a deed in 1993. When the Moradabad Development Authority (MDA) auctioned the same land to another buyer in 2008, the owner sued to invalidate the auction. The Trial Court dismissed the suit; the High Court allowed it. The Supreme Court reversed the High Court, holding the original sale deed was void because it violated statutory preconditions for transfer under Section 5(3) of ULCRA. The Court also held that the civil suit's real object was to challenge land ceiling proceedings without impleading necessary parties, thereby barring jurisdiction. The appeal was allowed and the suit dismissed.
