Savitha vs Chodamandalam M.S. General Insurance Co. Ltd. and Others

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

A woman injured in a motor accident appealed against inadequate compensation awarded by the lower court. She had claimed to be a tailor but failed to prove this occupation; that claim was correctly rejected. However, the Supreme Court found that her compensation for loss of amenities and future happiness was too low given her age and the severity of her injuries. The Court enhanced the award on the ground of whole-body disability resulting in loss of future earning capacity, and added interest at six per cent. The appeal was allowed.
