SRI ANTHONY alias ANTHONY SWAMY vs THE MANAGING DIRECTOR, K.S.R.T.C

Bench: 3 — R.F. Nariman, Navin Sinha, B.R. Gavai

In Brief

The appellant, a 45-year-old painter, lost his left leg in a bus accident and sought enhanced compensation for permanent disability. The High Court had awarded ₹5,10,350. The Supreme Court held that compensation for loss of future earnings must reflect the actual impact of disability on earning capacity, not mechanically apply the disability percentage. Medical evidence showed 75% leg disability (37.5% whole body), completely preventing the appellant from working. The Court enhanced compensation to ₹11,97,350, including ₹6,93,000 for loss of future earnings, ₹2,50,000 for future prosthetic replacements, and ₹50,000 for loss of amenities.
