This appeal concerns a bail application by a person charged under the Narcotic Drugs and Psychotropic Substances Act, 1985. The High Court had rejected the bail application, reasoning that a co-accused released on bail had not surrendered. The Supreme Court held that the non-surrender of a co-accused cannot be a valid ground to refuse bail to another co-accused. Each bail application must be considered independently on its own merits. The Court set aside the rejection order and directed the High Court to reconsider the bail application afresh, preferably within two months, in light of the fact that charges have been framed.
