Secretary Managing Committee BSMPG College Roorkee vs Samrat Sharma & Others

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

A college managing committee terminated the services of an employee after a disciplinary enquiry found him guilty of using indecent language and misbehavior. The High Court set aside the termination, holding the penalty disproportionate to the charges. The Supreme Court reversed the High Court's judgment, holding that judicial interference in administrative disciplinary proceedings is limited to examining procedural regularity and the absence of evidence. Sufficiency of evidence and penalty proportionality remain within the exclusive domain of the administrative authority and cannot be re-appreciated by courts. The appeal was dismissed.
