In Brief

The Supreme Court examined whether supervisors employed in government security and minting units could claim Double Over Time Allowance under the Factories Act, 1948. The Court held that supervisors working as government servants during 1988–2005 are governed by civil service rules, not labour legislation. Under the Fundamental Rules (1922), government servants' entire time is at the disposal of the Government without automatic claim for extra remuneration. The Court found the tribunal and High Court failed to distinguish between government and private service employment and applied labour law incorrectly. The Court allowed the appeal, setting aside the decision granting overtime allowance, but ordered no recovery from employees already paid.
