Sh. Marwadi Rajasthan Education Society, Latur vs State of Maharashtra & Anr

Bench: 2 — Kurian Joseph

In Brief

A property owner who had land acquired by the state sought to withdraw compensation money deposited with a Reference Court. The Supreme Court allowed partial withdrawal, permitting the appellant to withdraw 50% of the deposited compensation without requiring any security. The remaining 50% could be withdrawn subject to furnishing appropriate security to the Reference Court's satisfaction. The Court clarified that this order would apply to all deposits already made or to be made in future.
