The Supreme Court reversed the High Court's judgment that had set aside the promotions of medical faculty members to the post of Professor in Aligarh Muslim University on the grounds of lacking Ph.D. qualifications. The Court held that for medical colleges, the minimum qualification is MD/MS as prescribed by the Medical Council of India, not the Ph.D. required by general UGC Regulations. The UGC Regulations 2010 explicitly exempt medical faculties from the general rules and direct them to follow health ministry regulations. The judgment was set aside and remanded for consideration of other points raised by the petitioner.
