A Chief Whip of the Indian National Congress challenged the Election Commission's circulars introducing the NOTA (None of the Above) option in Rajya Sabha elections. The Supreme Court held that NOTA is constitutionally valid only in direct elections (Parliament and State Assemblies) under the PUCL principle, not in indirect elections. Rajya Sabha elections are fundamentally different: they use proportional representation with open ballot and quantifiable, transferable votes. Introducing NOTA undermines party discipline, indirectly defeats anti-defection law, and risks encouraging corruption. The Court quashed the circulars, holding that the Election Commission misread the PUCL judgment and exceeded its constitutional authority by applying NOTA outside the direct-election context.
