The Supreme Court quashed circulars issued by the Election Commission of India introducing the NOTA (None of the Above) option in Rajya Sabha elections. The petitioner, a Congress Chief Whip, challenged the circulars as unconstitutional and contrary to Article 80(4) and the Representation of the People Act, 1951. The Court held that while the PUCL judgment authorized NOTA for direct elections based on universal adult suffrage, it cannot extend to indirect Rajya Sabha elections governed by proportional representation and party discipline. Allowing NOTA in Rajya Sabha would undermine vote value in the single transferable vote system, encourage defection by circumventing anti-defection provisions, and compromise electoral purity. The Election Commission exceeded its authority by extending a judicially-sanctioned right beyond its constitutional and statutory scope.
