Shakuntala Yadav & Ors vs State of Haryana & Ors

Bench: 2 — Kurian

In Brief

Shakuntala Yadav and others held agricultural land in village Sarhaul, Gurgaon falling within a Lal Dora (village green area) designated for exemption from acquisition. After the State acquired neighbouring lands, the applicants sought release of their land for development as an IT unit. The High Powered Committee and High Court rejected their request solely on the ground that title had vested in the government. The Supreme Court allowed the appeal, holding that mere vesting of title does not complete an acquisition without actual physical possession documented by official records (Rojnama). The Court remanded the case for fresh consideration, directing that if the land is within Lal Dora, it must receive equal treatment as similar neighbouring land already released.
