In Brief
Sham Lal was convicted by the High Court for dowry death under Sections 304-B and 498-A IPC after the trial court acquitted him. His wife Usha and daughter died from burn injuries in 1992. The Supreme Court set aside the High Court's conviction, holding that the trial court did not err in finding that the prosecution failed to prove cruelty or establish the dowry demand and payment. The Court applied the principle that acquittals should not be disturbed unless wholly perverse, and found the High Court's reliance on witness testimony contradicted by bank records was unsustainable.
