Shankar Hiranna Rajanna vs Maharashtra Housing and Area Development Authority and Ors

Bench: 2 — Nariman

In Brief

This case concerns the redevelopment of four dilapidated MHADA buildings acquired in 1990. After decades of litigation, the High Court directed that a developer must obtain 70% consent of occupants before proceeding. The Supreme Court, upon verification by the Chief Officer of MBRRB, found that M/s Raj Doshi had secured 78.89% consent. The Court approved the developer's proposal offering 425 sq. ft. carpet area and ₹25,000 monthly transit assistance—terms more favorable than alternatives. The Court directed tenants to vacate within 8 weeks, ordered MHADA to issue clearances, and recorded the developer's commitment to complete construction within 42 months thereafter. Appeals allowed.
