Shantaben & Ors vs National Power Transport & Anr

Bench: 2 — Dinesh Maheshwari

In Brief

In this motor accident claim, a 23-year-old self-employed man died in a bus collision in 1987, leaving his wife, mother, father, and two minor sisters as dependents. The Tribunal awarded Rs. 3,00,000 compensation, but the High Court refused enhancement. The Supreme Court held the compensation inadequate as it failed to account for future income prospects. Applying established principles, the Court enhanced compensation by Rs. 1,20,240 by adding 40% for future prospects and using a multiplier of 18. The enhanced amount was apportioned 50% to the widow and 25% each to the sisters.
