Shashin Patel and Anr. v. Uday Dalal and Ors. concerns membership rights in a co-operative housing society. The predecessors of appellants were tenants in a building acquired by the Society in 1995. Although Narendra Patel received a membership offer in 1995 and the Society resolved to admit him as a member in 2005 upon payment, he did not pay the contribution amount. His heirs later deposited the required amount with interest. A statutory authority directed admission of the heirs as members, but the High Court set aside this order. The Supreme Court restored the membership, holding that the long-standing resolution and occupancy could not be ignored, and subsequent General Body ratification was valid. The Court allowed the subsequent sale and membership transfer to the purchaser, while preserving the Society's right to claim enhanced interest for delayed payment.
