Sheela Goyal & Ors vs Advisor to the Administrator, UT, Chandigarh & Ors

Bench: 2 — Kurian

In Brief

A widow whose booth allotment was cancelled for alleged sub-letting challenged the cancellation. The Supreme Court set aside the cancellation and directed that she be afforded a fresh opportunity to file a representation to the Administrator, undertaking that she would personally operate the booth and not sub-let it. The Administrator must consider this representation after giving her a hearing. Pending the Administrator's decision, the appellant's possession of the booth is protected and maintained. The appeal was disposed of with these directions.
