Shio Shankar Dubey & Ors vs State of Bihar

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Shio Shankar Dubey and others appealed their murder convictions under Section 302 IPC following a High Court judgment. The Supreme Court examined whether the prosecution proved guilt through eyewitness testimony and medical evidence. The Court found that the eyewitness account provided by a person accompanying the deceased was credible; police had promptly recorded all five accused persons' names and roles within half an hour on the spot; and medical evidence corroborated the ocular testimony. Finding no error in either the trial or appellate court's reasoning, the Court dismissed the appeal and upheld the conviction and sentence.
