Two FCI officials and others were convicted of conspiracy and misappropriation of 1040 bags of fertilizer through falsification of records. Although a complaint initially alleged loss of only 540 bags, investigation revealed the entire 1040 bags were criminally misappropriated. Five hundred bags loaded into trucks were diverted and never reached the FCI godown; false entries were deliberately made in official registers to conceal this. The Supreme Court upheld the convictions, finding the evidence of vehicle owners, drivers, and witnesses credible and corroborated by documents, rejecting arguments about inconsistencies. Concurrent findings by trial and appellate courts were not perverse.
