Shivaram & Anr vs State of Karnataka

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Appellants were acquitted of charges under Sections 307, 504 and 34 IPC but convicted under Section 326 IPC for causing hurt. The trial court imposed lenient sentences (10 days for appellant 1, aged 74; 1 day for appellant 2) considering mitigating circumstances including the appellant's age, injuries sustained, and that the second appellant's assault was spontaneous. The State's appeal to the High Court succeeded, leading to enhanced sentences of six months imprisonment and Rs. 50,000 fine each. The Supreme Court held the sentence enhancement was unjustified, set aside the enhanced imprisonment but maintained the enhanced fine.
