The State of Punjab appealed against a High Court judgment that had partially allowed the accused's appeal. The trial court had convicted Harjit Singh and Sukhwant Singh for murder (Section 302) based on an incident where Singh allegedly struck the victim with a kirpan (small sword) during a quarrel. The High Court reduced Harjit Singh's conviction from murder to culpable homicide not amounting to murder (Section 304 Part II) with 10 years imprisonment, and acquitted him of simple hurt charges. It upheld Sukhwant Singh's conviction for hurt. The Supreme Court dismissed the State's appeal, finding no grounds to disturb the High Court's modified convictions and sentences.
