In Brief
A woman and her two co-accused were prosecuted under the Gangsters Act for their roles in a conspiracy to murder a court employee over a property dispute. The appellant challenged the prosecution as being based on a single FIR. The Supreme Court held that under the Gangsters Act, unlike some other statutes, a person can be prosecuted even for a single offence if they are shown to be a member of a gang engaged in prescribed anti-social activities. Since the appellant was part of a conspiracy by a gang leader to commit murder for pecuniary gain, she qualified as a 'Gangster' and could be prosecuted. The Court dismissed the appeal and upheld the High Court's refusal to quash the proceedings.
