This batch of cases, referred by a Division Bench, addressed whether persons with disabilities are entitled to reservation in both recruitment and promotion under the Persons with Disabilities Act, 1995. The Supreme Court held that such reservation applies horizontally under Article 16(1) to all groups and both modes of employment. The Court distinguished Indra Sawhney, which prohibited reservation in promotion under Article 16(4) for backward classes, ruling that this prohibition does not apply to disability-based reservations. Once a post is identified as suitable for PWD under Section 32, the 3% reservation must follow under Section 33, regardless of recruitment mode. The computation must be uniform across all groups. The appeals were disposed of accordingly.
