Sirdar K.B. Ramachandra Raj Urs. (dead) Through Lrs vs Sarah C. Urs & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Court examined a dispute over an agreement for sale of property where the defendant executed the contract as a power of attorney. The plaintiffs sought specific performance of the full agreement, but the Court held that the power of attorney could only bind the 50% share belonging to the principal, not other shares that had devolved by succession under the Hindu Succession Act. The appeals were partly allowed, limiting the plaintiffs' rights to 50% of the property, with no refund of consideration despite the property's increased value. The trial court was directed to divide the property equally within four months.
