SITA RAM & ORS vs STATE OF RAJASTHAN

Bench: 3 — Uday Umesh Lalit, S. Ravindra Bhat, Bela M. Trivedi

In Brief

A mob assault in a disputed agricultural field in Rajasthan (1982) resulted in the death of Ghadsee Ram. Eight accused were convicted of murder and sentenced to life imprisonment. The Supreme Court modified the conviction to culpable homicide not amounting to murder, holding that the injuries (caused by blunt object), the property dispute context, and the escalation from verbal altercation to violence satisfied Exception 4 to Section 300 of the IPC. The Court reduced the sentence to six years imprisonment and directed release of those who had served six years. Two juvenile accused were to be handled under the Juvenile Justice Acts.
