Supreme Court of India 2017-11-14 remanded

Sivanandan C.T. & Ors vs High Court of Kerala & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Kerala High Court selected District and Sessions Judges in 2015 using written examination (300 marks) and viva-voce interview (50 marks). A 2012 Full Court Resolution stipulated no minimum marks for the interview. After the selection process concluded, the Administrative Committee introduced a minimum marks requirement for the viva-voce and revised the merit list, removing some candidates. The Supreme Court held this impermissible, finding that changing selection rules after the process is completed violates fundamental fairness. The Court relied on K. Manjusree precedent and referred the matter to a larger bench due to conflicting views in Tej Prakash."
