Sk. Bhikan S/o Sk. Noor Mohd vs Mehamoodabee w/o Sk. Afzal & Ors

Bench: 2 — Abhay Manohar Sapre

In Brief

This appeal concerns a property dispute between a brother and sister in a Muslim family. The sister sought partition of land claiming she inherited a share from their deceased father under Mohammedan Law, while the brother claimed he had self-acquired the property through purchase. The trial court dismissed the suit, but the first appellate court allowed it, granting the sister her inheritance share. The brother appealed to the High Court, which dismissed his appeal in limine, finding no substantial question of law. The Supreme Court held that questions involving document interpretation and ownership determination are substantial questions of law that require the High Court to admit, frame appropriate issues, and decide the appeal on merits. The Court set aside the High Court's dismissal and remanded the case for proper adjudication.
