Smriti Madan Kansagra vs Perry Kansagra

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

This case concerns a dispute between separated parents over custody and access to their child resident in Kenya. The Supreme Court of India had previously passed directions for the child's care. The appellant sought confirmation that the High Court of Kenya's registration of the Supreme Court's judgment constitutes adequate compliance with orders to obtain a 'Mirror Order' from a Kenyan court. The Court held that registration of the judgment, done by the High Court of Kenya with full knowledge of the facts, suffices. The Court additionally permitted the appellant one extra annual visit coinciding with the child's birthday, bringing the total to two annual visits. The Court clarified that the child need not be brought to court every six months, but interactions during vacations may be arranged to monitor welfare."
