Supreme Court of India 2025-02-12 dismissed

SMT. DHANLAXMI URF SUNITA MATHURIA & ANR vs STATE OF RAJASTHAN & ORS

Bench: 2 — Sudhanshu Dhulia, Ahsanuddin Amanullah

In Brief

The petitioners sought a Supreme Court review of High Court orders dismissing a habeas corpus petition as infructuous. The petition alleged their mother was unlawfully detained, but she returned home before judgment, rendering the petition moot. The High Court dismissed it and also rejected subsequent review and miscellaneous applications. The petitioners contended they were humiliated by police statements regarding matrimonial matters made during proceedings. The Court held that statements made during litigation, however uncomfortable, do not constitute humiliation, and the court's duty to seek truth may require uncomfortable questioning. The petition was dismissed as misconceived.
