A family property dispute arose 55 years after an oral partition in 1968 and 45 years after registered sale deeds in 1978. Grandchildren of one branch sought partition in 2023. The trial court rejected the suit under Order 7 Rule 11 CPC as barred by limitation and lacking cause of action. The High Court remanded it for trial, finding triable issues. The Supreme Court allowed the appeal and set aside the High Court's order. It held that registered documents provide constructive notice to all parties, the suit was manifestly barred by limitation, and rejection at the threshold stage was proper without proceeding to trial.
